Federal Regulations and Guidance Relating to Religious Conscience and Hardship Exemptions from the State’s Shared Responsibility Payment Penalty

Rhode Island General Laws section 44-30-101(h) requires HealthSource RI to determine eligibility for hardship and religious conscience exemptions from the State’s shared responsibility payment penalty consistent with HealthSource RI’s regulations as well as applicable federal regulations and guidance that were in effect on December 15, 2017. The below federal regulations and guidance were in effect on December 15, 2017. Accordingly, HealthSource RI will determine eligibility for the hardship and religious conscience exemptions from the State’s shared responsibility payment penalty in accordance with its regulations at 220-RICR-90-00-1 and the following federal regulations and guidance, to the extent applicable:
